*Oregon is a sanctuary state, which means (ORS 181A.820) Oregon officers cannot enforce federal immigration laws, with the exception of arresting individuals who are criminally charged and subject to a federal magistrate’s warrant.

Information Requests: Staff Guidance

General Guidance

District property is protected. Immigration enforcement agents cannot enter without proper legal authority. They must present a judicial warrant issued by a court.
Student and family information is private. Staff will not ask about or disclose immigration status. That information is protected by law and district policy.
TTSD is legally obligated to educate students regardless of citizenship status.
TTSD will follow the law.
TTSD will implement its policies and procedures to ensure all students receive an education.
TTSD will comply (when required) with legally authorized federal and state authorities.
TTSD will comply with longstanding Oregon Sanctuary Laws.

If Asked for Student Records

Notify your administrator immediately
Require the request in writing, provide no records, except to a caregiver with ed rights
Submit the written request/subpoena to the district office, attention of the Director of Student Services
District staff should not take steps to warn or interfere with law enforcement officers, whether local, state, or national attempting to carry out their duties

If Law Enforcement Wants to Speak to a Student

If Law Enforcement Wants to Remove a Student

Except in child abuse situations, law enforcement agencies are required to present a warrant or similar legal authorization to remove a student from school without parental permission.

In such a case:

Notify your administrator immediately
Do request that the officials act in a manner that causes the least disruption
Do Not attempt to physically intervene if law enforcement agents remove the student from school but call the School Resource Officer if federal or state officials are involved in the removal
